It is of great value for PALFINGER to protect your data. We process your personal information on our career portal exclusively in agreement with the following fundamentals and in compliance with the applicable data protection regulations. The following privacy policy describes how PALFINGER US Holdings, Inc. and its affiliated entities (collectively referred to as, "PALFINGER") handles and protects data provided by employment candidates in connection with the recruiting process. Definitions

Candidate Data in the recruiting process means all information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you, your household, or device. This includes information such as your name, e-mail address, telephone number, home­ address, data of your CV and other documents you provide for the recruiting process.

Processing refers to any action performed on Candidate Data, such as collecting, recording, organizing, storing, transferring, modifying, using, disclosing, or deleting.

Definitions


Candidate Data in the recruiting process means all information that identifies, relates to, describes, references, is reasonably capable of being associated with, or could reasonably be linked, directly or indirectly, with you, your household, or device. This includes information such as your name, e-mail address, telephone number, home¬ address, data of your CV and other documents you provide for the recruiting process.
Processing refers to any action performed on Candidate Data, such as collecting, recording, organizing, storing, transferring, modifying, using, disclosing, or deleting.


Data Collection


You agree that, in addition to collecting Candidate Data directly from you, PALFINGER may collect Candidate Data from third parties, for example, from recruiters, in connection with a background or employment check or an employment reference (subject to your consent where required by law) or, to the extent permitted by law, from a recruiting or other website where you may have provided information about your work experience or interests.

In order to apply for a job at PALFINGER or to use other services on our career portal it is necessary to create an application profile. The profile includes your name, your e-mail address and your country of residence, as well as any other information that is voluntarily provided.

Sensitive personal information is a subtype of personal information consisting of specific information categories. We may collect or use Candidate Data that falls within the sensitive personal information categories listed in the table below.

Additionally, you agree other data - besides the profile data and information voluntarily provided by you - can be collected and implemented (added) to your account automatically when registering a candidate profile.


We retain all categories of Candidate Data for the time periods set forth in Purpose of Processing and Deleting Data section.


You will be asked about the visibility settings for your profile, which you may update at any time. Depending on your settings the profile can:


1) Serve as the basis only for single applications that you apply to (Visibility option "only for the position I have applied for")

2) Or be considered for other positions within the PALFINGER group (Visibility option "for positions within the PALFINGER group").

The creation of a candidate profile does not yet constitute an application. If you apply for an advertised job, the application contains the information you deposit in your candidate profile as well as other documents and data provided by you. The application also contains personal data and will be handled with the appropriate care.


Security and Confidentiality


PALFINGER employs technical and organizational measures designed to protect the integrity, confidentiality, security and availability of Candidate Data, and to comply with applicable legal requirements for information security. PALFINGER limits access to internal systems that hold Candidate Data to individuals who need access for a legitimate business purpose.


The safety and security of your Candidate Data also depends on you. Where we have given you (or where you have chosen) a password for access to certain parts of our career portal, you are responsible for keeping this password confidential. We ask you not to share your password with anyone.


Unfortunately, the transmission of information via the internet is not completely secure. Although we employ security measures designed to protect your Candidate Data, we cannot guarantee the security of your personal information transmitted to our career portal. Any transmission of personal information is at your own risk. We are not responsible for circumvention of any privacy settings or security measures contained on the career portal.


Purpose of Processing and Deleting Data


The processing of your application data exclusively takes place in the context of our personnel selection procedures. Usage of the data for other purposes is expressly excluded. PALFINGER processes your data exclusively to the extent permitted by law and as far as it meets your approval.


A deletion or change of the application profile in total or individual information or settings (in particular settings about the visibility of your application profile) in your application profile is possible at all times in the setting options of your profile.


In case of a cancellation of the candidate profile or the revocation of the privacy policy your account information and also all ongoing applications addressed to us will be withdrawn.


The following deletion dates will be applied in the event that you do not request deletion, or if you request deletion but applicable law requires retention for a specified time period (based on the candidate's country of residence):

If you would like your candidate profile to be visible to other PALFINGER recruiters in the PALFINGER group, we ask you to ensure that the visibility options have been configured appropriately (see section "Data Collection"). Via your candidate profile a notification service can be activated. This notification service informs you via e-mail about vacancies advertised at PALFINGER, as far as they match the search criteria specified by you. The search criteria can be adjusted at any time in the options of your candidate profile.

Sale of Candidate Data


PALFINGER does not sell Candidate Data, and PALFINGER does not share Candidate Data within the meaning of the California Consumer Privacy Act of 2018, as amended by the California Privacy Rights Act of 2020.

Recipient and Transmission of Data (Sharing with Third Parties)


For purposes of the recruiting process, Candidate Data is shared exclusively with employees of the PALFINGER entity to which you made an application for employment. Your Candidate Data may be transmitted and made available to other employees within the greater PALFINGER group, provided that you have configured your visibility settings appropriately in your candidate profile. Transmission to third parties outside the PALFINGER group is excluded. All employees who have access to your Candidate Data as part of the personnel selection process are bound by data protection and confidentiality. However, we have service partners and service providers who support us in running this platform. We have contracts in place with these partners to ensure the security of your data and to prevent its disclosure to third parties.


In addition, PALFINGER may be required to disclose certain Candidate Data to other third parties (1) as required by law; (2) to protect PALFINGER's legal rights to the extent authorized or permitted by law; or (3) in an emergency where the health or safety of a candidate or other individual may be endangered. In addition, in the event of a re-organization, merger, sale, joint venture, assignment, or other transfer or disposition of all or any portion of PALFINGER's business, PALFINGER may transfer Candidate Data to successor entities or parties.

Rights of the Affected 


You are entitled to information, correction, blocking or deletion of the data collected by you at any time unless legal requirements preclude this.

You can delete the profile you have created and the associated application documents at any time or request this deletion via the form on our website: Request for information

In addition, you have the right to contact the data protection officer of PALFINGER AG or the assigned supervisory authority if there are any questions about data protection or stored information.  If you are unsure of which supervisory authority is responsible for privacy in your jurisdiction, please contact us, and we will endeavor to help you.


Anti-Discrimination: PALFINGER will not discriminate against Candidates in the recruiting process for exercising any rights under relevant privacy laws.


You have reviewed this Notice and agree that PALFINGER may process your Candidate Data in accordance with this Notice.


Changes to this Notice


PALFINGER reserves the right to modify this Notice by posting changes to relevant PALFINGER websites.  If you submit additional Candidate Data or request to be considered for a PALFINGER position following the effective date of a modified Notice, your Candidate Data will be handled in accordance with the Notice in effect at that time.
